Terms and Conditions for E-Learning at tecteam

Registration/Order

A registration or order becomes binding as soon as it is confirmed in writing by tecteam Bildungsinstitut GmbH, hereinafter referred to as “tecteam.”

Costs/prices

Costs/prices are listed in the respective e-learning course description or in the quote or continuing education contract prepared by tecteam.

We will invoice you for our services after your order has been placed and before the e-learning course begins. All costs and prices listed are net amounts and apply to a single participant. The applicable VAT will be added to all costs and prices. Invoiced amounts are due in full upon receipt of the invoice. Participants are responsible for their own internet access costs.

Cancellation/termination

Cancellation of a registration or order must be made in writing via email or mail. If tecteam receives the cancellation less than two weeks before the confirmed start date, tecteam will charge 50% of the cost as a cancellation fee. For cancellations received by tecteam later than one week before the start date, or in the event of termination during the e-learning course period or withdrawal from the course, the full cost must be paid.

Access

tecteam grants participants access to the e-learning content only if the invoiced amount has been received in tecteam's account prior to the start date of the respective course as confirmed by tecteam.

Implementation

The e-learning courses, self-study modules, and screencasts will be made available to participants during the time periods (duration) specified in the registration confirmation or in the continuing education plan. During this time, participants can contact support staff via a forum. The contact persons are generally available from 9:00 a.m. to 12:15 p.m. and from 1:00 p.m. to 4:15 p.m. The contact persons are not available on Saturdays, Sundays, or public holidays in North Rhine-Westphalia.

During the course, participants complete the exercises provided in the e-learning course to track their learning progress. The instructors provide feedback on submitted exercises and make their comments available to the participants in a timely manner. For self-paced e-learning courses (self-study modules), participants monitor their own learning progress. They can contact an instructor if they have any questions. At the end of the program, support ends, and participants no longer have access to the e-learning course content, exercises, or forums.

When participating in e-learning, participants are responsible for ensuring that their hardware and software (e.g., Internet access, email address, browser) are functioning properly. This applies in particular to any restrictions on Internet use, such as those imposed by an employer.

At the end of the course, participants will receive a tecteam certificate of completion with the notation “successfully completed” if they have passed all exercises. If not all exercises have been passed, participants will receive a non-certified certificate with the notation “participated.” Participation in self-paced e-learning courses is certified by a non-certified certificate.

tecteam reserves the right to change contact persons and to postpone or modify the course schedule or learning content. tecteam has the right to postpone or cancel e-learning courses—even after they have begun—in the event of the unavailability of contact persons or for other important reasons. In such cases, tecteam will notify the participants and provide alternative dates, if possible. If this is not possible, tecteam will reimburse participants for the cost of the e-learning courses that do not take place.

Enrollment in an e-learning course is not transferable to another person.

Forum posts

Participants are solely responsible for their posts in the forums provided by tecteam. tecteam may sort, modify, or delete participants' posts at its sole discretion.

In the case of posts that are likely to violate human dignity or in the event of other serious violations, tecteam reserves the right to exclude the person responsible from further participation in the e-learning courses or continuing education programs.

Contents

When specified in the course descriptions, the e-learning courses cover key content from the tekom competency model. tecteam has the discretion to interpret the content described therein and makes no guarantee that the learning content and objectives described in the model will be covered in their entirety.

Confidentiality

The e-learning course content, exercises, and forums may only be used by individuals who are listed as participants in the registration form or in the offer or continuing education contract prepared by tecteam. Participants agree to keep all passwords and login information they receive confidential and not to disclose them to third parties.

Copyright and exploitation rights

All documents and materials provided by tecteam as part of the e-learning courses become the property of the participants as soon as they are made available. All content, documents, and materials are subject to copyright and contractually agreed-upon rights of use. The reproduction of the provided content, documents, and materials for purposes not expressly authorized by tecteam, as well as their distribution, use, and disclosure to third parties, is expressly prohibited. Any violation of these rights will result in claims for damages.

Privacy Policy

tecteam collects and processes personal data in accordance with the provisions of the General Data Protection Regulation (GDPR). Information about data protection at tecteam can be found on the tecteam website (tecteam.de).

As part of the business relationship, participants must provide tecteam with the personal data necessary for establishing and conducting the business relationship and fulfilling the associated contractual obligations, or which tecteam is legally required to collect. Personal data is disclosed only to individuals who are directly involved in conducting the e-learning courses or continuing education programs.

Additional agreements/deviating agreements

Additional or deviating agreements must be made in writing, e.g. by e-mail. Verbal collateral agreements are not valid.

For participants in e-learning courses whose continuing education is funded by public funding agencies (e.g., the Employment Agency, pension insurance providers, etc.), different or additional agreements may apply. These are listed in the respective course description or continuing education contract and supersede the corresponding provisions in these Terms and Conditions of Participation or supplement the terms listed here.

Liability

If an e-learning course is canceled for reasons attributable to tecteam, only the costs already paid for the course will be refunded. Any further claims are excluded. For damages attributable to tecteam—regardless of the legal basis—tecteam is liable only to the extent that it acted with intent and/or gross negligence.

All information in the e-learning courses is provided by tecteam to the best of its knowledge and belief. tecteam assumes no liability for any errors in the information provided in the e-learning courses—whether verbally or in writing—or contained in the documents or data storage media provided. Likewise, tecteam assumes no liability for any resulting damages or consequential damages arising from such errors.

Place of jurisdiction

The place of jurisdiction for all legal matters arising from registration for or orders of tecteam e-learning courses is Dortmund. The laws of the Federal Republic of Germany apply.

Partial invalidity

Should individual provisions of these conditions of participation be invalid, this shall not affect the validity of the remaining provisions. In this case, the ineffective provisions shall be replaced by effective ones with corresponding content.
